Are you expected to appear for a criminal hearing soon? A criminal hearing is the central moment in a criminal case during which the judge determines whether the defendant is guilty of a criminal offense and, if so, what sentence will be imposed. During a criminal hearing at court, the public prosecutor, the defendant, their lawyer, and sometimes the victim convene to discuss all relevant facts and evidence. How does a criminal hearing proceed?
A criminal hearing begins with identification and an explanation by the judge about your rights, such as the right to remain silent. The public prosecutor reads out the charges and explains why you are being prosecuted. The judge then asks questions to you, your lawyer, and any witnesses. The victim or their lawyer may address matters regarding damages and express their wishes. After this, the prosecutor presents the sentencing demand (‘requisitoir’). Your lawyer presents the defense and may respond to all points raised, after which you, as the defendant, have the right to the final word.

What does a criminal defense lawyer do during the hearing?
A criminal defense lawyer thoroughly prepares your defense, coordinates the submission of evidence, and considers your personal circumstances. During the hearing, your lawyer speaks on your behalf, responds to the charges, and pleads for acquittal, dismissal of prosecution, or mitigation of the sentence. Types of criminal hearings
In minor cases, a single judge (‘politierechter’) presides; in more complex or serious cases, you appear before a panel of three judges (‘meervoudige kamer’). Outcomes range from acquittal, dismissal of prosecution, to conviction and sentencing. Afterwards, there is typically the option to appeal, where your lawyer can continue to represent you.
